Why do I need a GDPR clause in my tenancy agreement?

When using Notify, you will be sharing your tenant data with us so we can provide our services.

Under UK GDPR, personal data must be handled lawfully, fairly and transparently. As the organisation providing us with the tenant information, you need to make sure you have a lawful basis for sharing that information and that your tenants have been appropriately informed.

This is why having the correct GDPR wording in your tenancy or pre-tenancy agreements is so important.

If tenant information is shared with third parties, you need to make sure the processing and sharing of that information has an appropriate lawful basis under UK GDPR.

Your tenancy documentation and privacy information should clearly explain how tenant data is used and who it may be shared with.

Having appropriate GDPR clauses helps you demonstrate that you have considered these requirements and have been transparent with your tenants.

In short:

  • Tenant data is personal data and needs to be handled appropriately.
  • You need a lawful basis for processing and sharing it.
  • Tenants should be told how their information will be used and who it may be shared with.
  • Appropriate contractual and privacy wording helps evidence that transparency.
